Terms and Conditions — BADI Culture
1. Subject of the contract
BADI Culture sells the goods offered in the online shop to customers under the following terms and conditions of delivery and sale (T&Cs).
2. Conclusion of the contract
The contract between the customer and BADI Culture is only concluded upon receipt of an order from the customer and acceptance of that order by BADI Culture. The customer places the order via the internet. BADI Culture accepts the order by sending the customer an order confirmation (by fax, email, or postal mail) or by delivering the ordered goods (including a delivery note).
3. Product range
All information regarding the goods that the customer receives during the ordering process is non-binding. In particular, changes in design and technology that improve the functionality of a product, as well as errors in description, illustration, and pricing, are reserved. No goods are offered that do not comply with legal regulations.
4. Payment terms
All prices include VAT. The currency for deliveries within Switzerland is Swiss Francs (CHF). Payment options include the listed credit cards, Swiss Post Postcard, PayPal, and TWINT. Cash payments are accepted at our location. Business customers can order by invoice.

Percentage discount vouchers from different promotions cannot be combined.
5. Delivery conditions
We ship throughout Switzerland via Swiss Post for a fixed price of CHF 9.00 per shipment weighing up to 5 kg, unless otherwise stated. These shipping costs are added to the sales price. Shipping is free for orders over CHF 180.00. Shipments weighing between 5 kg and 20 kg are delivered for a fixed price of CHF 20.00 per shipment. Unless otherwise stated, for retailer and bulk orders , please contact contact@badiculture.com . Products not manufactured by BADI Culture may be shipped directly from the manufacturer/supplier. You will receive your order within 2-7 business days, unless otherwise stated. If a product is not in stock, it cannot be ordered, unless otherwise stated. International shipments are made upon request and prepayment.
6. Retention of title
The delivered goods remain the property of BADI Culture until full payment has been received. BADI Culture is entitled to register a corresponding entry in the retention of title register. If the customer defaults on payment of the purchase price, BADI Culture is entitled to withdraw from the contract (notice of withdrawal) and repossess the goods.
7. Right of return/cancellation
You have a 14-day right of return. Please send any returns back to us within 14 days of receiving the goods (the date of dispatch is decisive). We will refund your payment via the original payment method as soon as we receive the goods and they are undamaged and unaltered.

The buyer is responsible for return shipping costs. We will issue a refund once we have received the returned goods in perfect condition.
The buyer is advised to check the received goods for defects immediately upon receipt and to report these to the seller within the return period.
7.1.
Returned items must be unused, in their original packaging, and in perfect condition. Soiled, worn, or washed textiles will not be accepted. Packaging, especially for shoes/sneakers, is part of the product and must also be undamaged and in perfect condition. Scarves, wallets, shoe boxes, and sneaker boxes should not be taped shut or used as shipping boxes. If these conditions are not met, we reserve the right to refuse the return or charge 20% of the purchase price.
7.2.
Returns of underwear and swimwear are generally permitted. However, please only try them on over other underwear.
8. Warranty and Liability
The warranty is provided in accordance with statutory regulations.
9. Intellectual Property
BADI Culture reserves all rights to every design, text, and graphic on its website. Copying or any other reproduction of the entire website or parts thereof is permitted only for the purpose of placing an order with BADI Culture.
10. Data protection

BADI Culture assures that it complies with the provisions of the Swiss Federal Act on Data Protection and other applicable legal regulations when collecting, processing, and using personal data. Unless otherwise requested by the customer, customer data collected during order processing will only be used to ensure the smooth processing of the order. Disclosure to third parties is excluded.

By subscribing to our newsletter, your email address will be used for our own advertising purposes until you unsubscribe. You can unsubscribe at any time.
10.3.
This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses "cookies," which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of the website will generally be transmitted to and stored by Google on servers in the United States. 11. Jurisdiction and applicable law
These General Terms and Conditions and the contracts concluded on the basis of these General Terms and Conditions are subject to Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Lucerne.
12. Final Provisions
The sale of goods specified in the BADI Culture online shop is governed exclusively by the General Terms and Conditions (GTC) in their version valid at the time of the respective contract conclusion. These terms and conditions apply even if they differ from those of the customer. Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. Furthermore, BADI Culture reserves the right to amend these General Terms and Conditions at any time.
